Terms of Service & Participant Agreement
For Wellness Workshops and Psychoeducational Groups
Welcome! Before you register and pay for any Centerpoint Healing wellness workshops or psychoeducational groups (the "Services"), please carefully read these Terms of Service and Participant Agreement (the "Agreement"). By purchasing, registering for, or attending any of our Services, you agree to be bound by all the terms outlined below.
---
1. Educational and Informational Purpose Only (Not Therapy)
No Therapist-Client Relationship: The Services provided are purely educational, informational, and skills-based in nature. Participation in these workshops or groups does not establish a psychotherapist-client, counselor-patient, or any other clinical healthcare relationship under Colorado law, including the Colorado Mental Health Practice Act (C.R.S. § 12-245-101 et seq.).
Not a Substitute for Mental Health Treatment: These Services are not designed to diagnose, treat, cure, or prevent any mental health condition, psychological disorder, or medical issue. They do not constitute psychotherapy, clinical counseling, medical advice, or telehealth treatment.
Individual Responsibility: If you require mental health diagnosis, individualized treatment, or psychiatric care, you agree to seek the services of a licensed clinical professional or contact emergency services if you are in crisis.
2. Participant Eligibility and Safety
Age Requirement: You must be at least 18 years of age (or the age of majority in your jurisdiction) to register and participate independently.
Appropriateness of Fit: If a facilitator determines that a group or workshop is not a safe or appropriate fit for your current needs, we reserve the right to remove you from the session. In such cases, a prorated or full refund may be issued at our sole discretion.
3. Privacy, Community Guidelines, and Confidentiality
Peer-to-Peer Privacy: Because these groups are educational and open to the public, they are not subject to healthcare privacy laws such as HIPAA. However, to create a safe learning environment, all participants must agree to a Community Agreement: what is shared in the group stays in the group. You agree not to disclose the identities, personal stories, or private details of other participants.
No Guarantee of Confidentiality: While we ask all participants to respect peer privacy, you acknowledge that we cannot legally guarantee or enforce absolute confidentiality among other attendees. Please share only what you feel comfortable disclosing in a public, non-clinical group setting.
Recording Prohibited: To safeguard participant privacy, you are strictly prohibited from audio recording, video recording, or taking screenshots of any virtual or in-person sessions, materials, or participant feeds.
4. Fees, Payments, and Cancellations via Stripe
Payment Authorizations: By completing your purchase via Stripe, you authorize us to charge your selected payment method for the full registration fee listed.
Refund and Cancellation Policy: All sales are final. Registration fees for these workshops/groups are non-refundable and non-transferable unless the session is canceled entirely by the host. If you miss a scheduled session, no partial refunds or make-up dates will be provided.
5. Disputes Resolution
If You have any concern or dispute about the Service, Fees, Payments, or Cancellations, You agree to first try to resolve the dispute informally by contacting the Company.
6. Intellectual Property
Ownership of Materials: All materials provided during the Services—including but not limited to workbooks, slides, digital downloads, concepts, frameworks, and text—are the exclusive intellectual property of our practice.
Usage Restrictions: You are granted a limited, personal, non-transferable license to use these materials for your own personal growth. You agree not to copy, redistribute, resell, modify, or publicly share any part of the materials or use them for commercial or professional training purposes without explicit written consent.
7. Limitation of Liability and Release of Claims
Assumption of Risk: You voluntarily choose to participate in these educational workshops and assume all risks associated with learning and discussing personal growth, emotional wellness, and lifestyle topics.
Release of Liability: To the maximum extent permitted by Colorado law, you release, waive, and discharge our practice, its owners, employees, contractors, and facilitators from any and all liability, claims, demands, or causes of action arising out of any emotional distress, personal injury, or perceived lack of progress associated with your participation.
8. Governing Law and Jurisdiction
Colorado Jurisdiction: This Agreement is governed by, construed, and enforced in accordance with the laws of the State of Colorado, without regard to conflict of law principles. Any legal action or proceeding arising under this Agreement must be brought exclusively in the state or federal courts located in Colorado.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
By completing your payment via Stripe, you acknowledge that you have read, understood, and voluntarily agreed to be bound by these Terms of Service.
